Court Ordered Utusan Malaysian To Pay Guan Eng RM 200K For Defamation

Thursday, 15th Dec 2011

Court Ordered Utusan Malaysia to pay LGE RM200,000 in damages and RM25,000 in costs.

KUALA LUMPUR, Dec 14 — The High Court today foundUtusan Malaysiaguilty of making “malicious”, defamatory and untruthful statements against Lim Guan Eng, and ordered the Umno daily to pay him RM200,000 in damages and RM25,000 in costs.
Utusan Malaysia Had Made LGE RM 200K Richer!

Justice G.V Varughese, in an hour-long judgment delivered in Penang, outlined seven paragraphs in an Utusan article titled “Kebiadapan Guan Eng” in which the paper had “maliciously defamed Lim (picture above), and made him and the DAP look as if they are anti-Malay and anti-Islam.”
“The judge ruled that the defendant showed selective vendetta against DAP and the plaintiff,” Lim’s lawyer Jagdeep Singh Deo told The Malaysian Insider
“The ruling stated that Utusan had shown disdain for the highest standards of responsible journalism,” added Jagdeep.
The lawyer said, among other things, the article had accused the Penang chief minister of “attacking Malay institutions, being racist, being opposed to Malays, demolishing Malay stalls and villages, and cancelling the state’s Maulidur Rasul celebration.”
“The learned judge, after listening to witnesses brought in by both sides, ruled that Utusan’s allegations were malicious and not factually true,” added Jagdeep.
Lim, who is also Bagan MP and Air Putih assemblyman, filed a suit against Utusan for publishing allegedly defamatory words in the article.
In his statement of claim, the Penang CM said the words used, among others, were meant to portray him as a racist who objected to anything related to Malays.
In an immediate response, Lim said that Utusan should take heed of this incident and avoid slanderous reporting in the future.

Datuk Seri Najib risks Malaysia's reputation in his treatment of Anwar Ibrahim

Wednesday, 14th Dec 2011

If the opposition leader is convicted of sodomy he will become yet another victim of an egregious, politically suspect injustice: Report By Simon Tisdall On Tuesday 13 December 2011.

The portents do not look good for Malaysia's opposition leader, Anwar Ibrahim, whose trial on highly dubious sodomy charges draws to a close this week. If Anwar is found guilty – and the trial judge seems to have made up his mind already – he will not be the only or even the most important victim of an egregious, politically suspect injustice. Malaysia's democratic reputation will have been critically wounded, and for that outrage, Malaysians will have their prime minister, Najib Razak, to thank.

The plodding Najib's overriding objective is winning the general election expected next year, possibly within a few months. The son of Malaysia's second prime minister, the nephew of its third, president of the dominant United Malays National Organisation (Umno), and a former defence minister, Najib was born to power and is accustomed to wielding it. As the charismatic leader of the opposition coalition, Anwar represents the biggest challenge to his continuing ascendancy.

It hardly seems coincidental that the sodomy charges were levelled at Anwar shortly after the opposition inflicted unprecedented defeats on Umno and its allies in the 2008 elections. Anwar's main campaign plank – combating the official, institutionalised discrimination that favours ethnic Malays over the country's large ethnic Chinese and Indian minorities – threatened the post-colonial order that has kept Umno and its National Front coalition on top since 1957.

In a court appearance earlier this year, Anwar, 64, a married father of six, denied accusations he had had sexual relations with a former male aide. Homosexuality is punishable by law in Malaysia by caning and up to 20 years in jail. The allegations were "a vile and desperate attempt at character assassination" and a "blatant and vicious lie" spread by his political enemies, he said. "This entire process is nothing but a conspiracy by Najib Razak to send me into political oblivion by attempting once again to put me behind bars."

Najib flatly rejects the idea of a political vendetta. But the recycling of sodomy accusations – Anwar was jailed on a similar charge in 1998 and detained until the conviction was quashed in 2004 – suggests a lack of originality characteristic of the prime minister. The case turns on the testimony of the alleged victim and DNA evidence produced by the prosecution. Defence lawyers suggested this week that Anwar's accuser was a "compulsive and consummate liar" who may have been put up to it. Yet the trial judge has already declared the prosecution's evidence "reliable" and credible", leading Anwar to claim he is being denied a fair trial.

Najib gives every appearance of preparing for snap polls on the assumption that Anwar will be out of the way and the opposition decapitated. He told Umno's annual congress to prepare for battle because "the time is near" and urged delegates to work harder, for example by using social media, to attract a "new generation of Malaysians who are more critical and have rising expectations of the government". The party must adapt or face "tragedy", he warned.

To Najib's evident alarm, that tragedy almost occurred in July when tens of thousands of protesters took to the streets of Kuala Lumpur. The highly unusual public display of discontent was spurred by a range of factors: spending cuts, official corruption and cronyism, a defective electoral system, curbs on public assembly and debate, and state-imposed censorship considered draconian even by regional standards. The example of recent political upheavals in neighbouring Thailand and Singapore also played a part. In response, thousands were beaten and detained by police.

Now Najib is taking no chances as his lieutenants warn that Anwar is fomenting an Arab spring-style uprising – a so-called "hibiscus revolution". Having more or less reneged on shaky, post-July promises of civil rights reform, Najib is now pushing through remodelled restrictions in the form of the Peaceful Assembly act.

The act effectively makes peaceful assembly impossible by restricting it to undefined "designated places". No gatherings are permitted within 50 meters of prohibited places including hospitals, schools or places of worship. The police can dictate the date, time and place. Najib's idea of engaging the "new generation" of young Malaysians is to ban anyone under the age of 21 from organising a protest.

Opposition parties, lawyers and activist groups have condemned the new law, as has Amnesty International. But Khairy Jamaluddin, Umno's youth-wing leader, articulated Najib's paranoia last month when he accused Anwar's coalition of "trying hard to manufacture panic and disorder" by promoting street rallies instead of elections. "The opposition often quotes social movements in the Middle East to instigate people to take part in street revolutions and in the process manufacture a Malaysian version of the Arab spring," Khairy said.

Najib's authoritarian tendencies, blatant political scaremongering, and the judicial travesty that is Anwar's trial all suggest Malaysia's western allies, including Britain and the US, should take a closer look at their friend. Malaysia is valued as a trading partner, counterproliferation collaborator, and noncombatant member of the Afghanistan coalition. But the government's human rights record and democratic practices merit closer scrutiny.

In a visit last year, US secretary of state Hillary Clinton extracted a promise that Anwar would receive a fair trial. "The US believes it is important for all aspects of the case to be conducted fairly and transparently and in a way that increases confidence in the rule of law in Malaysia," she said. In a recent speech, Clinton urged all states to end discrimination on grounds of sexual orientation.

As Anwar's ordeal approaches an ugly climax, it seems increasingly unlikely that these benchmarks will be met. The next question is: what will Malaysians and their friends do about it?

Tidak Yakin Dengan Ketelusan PDRM dan SPRM Kerajaan Selangor akan Gunakan Penyiasat Luar Untuk Menyiasat Sharizat Jalil

Sunday, 4th December 2011

Skandal NFC: Keluarga Sharizat Guna Dana Untuk Beli Mercedes

Wednesday, 30th November 2011

Wednesday, 30th November 2011

Inilah sifat sebenar UMNO.

Jawabnya, jangan mimpi!

Hanya Pemimpin Sabah Yang Bangkit Menentang PERKASA

Wednesday, 16th Nov 2011

Personal Encounter with Lim Guan Eng: Comparison Between BN CM and Pakatan Rakyat CM

Tuesday, 15th November 2011

In the past we used to compared Datuk Nik Aziz house with the houses own by the BN leaders and we always found that BN leaders' own the houses beyond their financial capabilities. Today we are going to see how Lim Guan En Chif Minister, the Minister of Pulau Pinang aboard in an Economy Class and in the Airport qued with the rest of the passengers. Ask Taib Mahmud how he travelled to Australia for his colon treatment. This article is taken from

Lim Guan Eng: Good leaders that have humility are worth respecting...

As Ning and I were lining up to board our flight to Penang on Wednesday afternoon, I spotted a familiar face standing in front of us in the queue. So I whispered to Ning. Me: Look in front of us. It's Guan Eng.

Ning: Who?
Me: YAB Mr. Lim Guan Eng, the Chief Minister of Penang.
Ning: No lah.
Me: Yes lah! I know how he looks lah. It's the CM lah.
Ning: Takkan CM jalan sorang sorang. If he's the CM, where's the bodyguards and the officers and the rombongan and kaum kerabat?
Me: Tak percaya? Watch and learn.
So I walked up to Yang Amat Berhormat, introduced myself and asked to take a picture. He smiled and obliged. YAB CM: Hey, I know you! You're Ning Baizura!
Ning: YAB Lim, good afternoon.
YAB CM: Come, come, we take a picture. Vernon, here's my card. Email me the pictures OK.
Me: Definitely, sir.

Ambik kau. CM pun peminat katanya!
Ning and I really felt honoured. But we felt more surprised that the Chief Minister of a state was travelling all by himself like any normal rakyat jelata. But the biggest surprise in store for us was yet to come.

As usual, we sat in First Class. I expected the CM to be seated somewhere in front of us but then I realised he wasn't in First Class. Where did he disappear to???

I popped my head round the curtain that veils First Class and Economy Class and guess who I saw sitting in the front row seat of Economy quietly reading the newspapers?
YAB Mr. Lim, you have my deepest respect. You have made history by being the first Chief Minister in this country to sit in Economy Class whilst in office as Chief Minister. You really mean what you say when you talk about cost-cutting. Sir, you have shown me leadership by example.

Ask Taib Mahmud How he travelled to Australia For His Colon Treatment?

Of course I asked permission to take his picture sitting in Economy and he laughed. And I said I'd blogged about it and he laughed some more, and gave permission. Ketua Menteri yang berjiwa rakyat.

Leaked cable Reveals Ex-EC chief issued 60,000 Fake ICs In Sabah

Tuesday, 15th November 2011

People of Sabah especially the Kadazan/Dusun should ban these two traitors from entering their state if revelation by US Embassy is true.....www.Bukittunggal.Com

A leaked US Embassy cable carries an explosive charge against former Election Commission (EC) chief Abdul Rashid Abdul Rahim - that he admitted to issuing more than 60,000 fake Malaysian identity cards to foreign workers in Sabah in the 1990s - on Umno's orders.

The cable, posted on Wikileaks, quotes former Malaysians for Free and Fair Elections (Mafrel) chief Malek Husin as claiming that Rashid confessed this to him during a private meeting at Rashid's house on Oct 25, 2006.

In the cable marked confidential, Malek is said to have told US Embassy officials that Rashid (left) also confirmed Umno's launch of a "shadowy" campaign in the 1990s to wrest political control of Sabah - held until 1994 by the then opposition front PBS.

"During that decade, Umno granted citizenship and Malaysian identity cards to over 600,000 foreign migrant workers (predominantly Muslims from Indonesia and Mindanao in the Philippines) in Sabah, in exchange for their votes in state assembly elections.

"According to Husin, Rashid 'admitted to personally issuing over 60,000 fraudulent Malaysian ICs in Sabah', to help Umno assume political control there," the cable says.

Instant citizenship and voting rights for illegal immigrants have long been an issue in Sabah, with local leaders in and outside the BN coalition having repeatedly demanded a solution from the federal government.

However, nothing has come out of their demands.

It is claimed that the situation became acute in the 1990s, with the blame placed on the then Prime Minister Dr Mahathir Mohamad for allegedly launching what is now called 'Projek IC' - a clandestine operation said to involve the National Registration Department, related government agencies and their agents - to artificially boosting votes in favour of Umno and the BN.

In the 1994 state election, PBS - which held Sabah as an independent opposition front since 1985 - saw its majority hold of the state assembly reduced to a razor-thin margin over the BN.

Although PBS was eventually toppled with a string of defections to the BN by party stalwarts, many blamed the contentious 'Projek IC' for playing a major role in the success of BN's hostile takeover of the Sabah.

Wan Ahmad is 'anti-reform'

The cable, created on March 16, 2007, also includes Malek's claim that Rashid had also described EC deputy chief Wan Ahmad Wan Omar as "an Umno member who is anti-reform".

Malek is said to have told US Embassy officials that Rashid had intended to stay on as EC chief until "the number two is gone", with the aim of easing in the then EC secretary, Kamaruzaman Mohd Noor, as his successor.

In a separate meeting with Kamaruzaman, the cable quoted him as telling US Embassy officials that the EC was not in a position to push for reforms, as each and every proposal must go through the Prime Minister's Office for approval.

Kamaruzaman is also reported to have said that the EC had no power to investigate election day abuses, with it having to refer allegations of fraud or election tampering to either the police or the Anti-Corruption Agency, the predecessor of the Malaysian Anti-Corruption Commission.

Battle for polls reform 'very steep'

Based on meetings among US Embassy officials and the EC, Mafrel, Bersih and several academicians, the cable summarised that electoral reforms in Malaysia faced a "very steep uphill battle" as it moved towards the March 2008 general election - which ironically proved to be a watershed outing for opposition parties, which were able to deny the BN a two-thirds majority in Parliament.

The cable described the "Umno-led BN governing coalition" as keeping a tight rein over all important levers of power, including the EC, leaving little wiggle room for any efforts to open up the country's elections to greater transparency and fairness.

It pointed out that despite concerted efforts by Mafrel and Bersih to push for grassroots engagement in their bid for a revamp of an electoral system heavily tilted in BN's favour, "their best efforts will almost certainly not produce meaningful reforms", at least in the medium term.

"Umno, in power since independence, faces no effective public, opposition party or internal pressure to reduce its overwhelming powers of incumbency," the cable states.

Shafie Apdal ‘Caught’ With ‘Overpriced’ Projects

Tuesday, 15th November 2011

Projects awarded in Sabah by Umno vice-president and federal minister Shafie Apdal cost '15 times higher' than their actual quote.

The opposition in Sabah armed with “evidence” is gunning for Rural and Regional Development Minister Shafie Apdal following shocking disclosures of irregularities in rural development projects awarded through his ministry in Sabah.
Some 209 development projects have been identified for Sabah between 2011 and 2012 and the bulk of these projects involved the rural water and power supply projects covering various parts of Sabah, from Pulau Banggi to Sipitang.
Of the 209 rural development projects awarded, only 129 projects had been announced and of this, 49 totalling RM1,276.60 million were “ridiculously overpriced”.
Revealing the massive overpriced payouts, Kota Kinabalu MP Dr Hiew King Cheu said some projects were awarded at 15 times or 1,500% higher than the normal price.
He demanded that the Malaysian Anti-Corruption Commission (MACC) step in immediately and investigate these claims.
He said most of these projects are either invited tenders, negotiated tenders, or directly awarded.
“None of these projects was properly done through the Tender Board.
“Most of the companies awarded the projects are RM2 companies and some of the contractors involved are found to be closely linked to certain senior BN-Umno politicians from Sabah,” Hiew told a news conference here yesterday.

Evidence in hand

Hiew said that a careful study of the detailed tender documents provided by an insider had indicated that the lowest tender bid did not get the job.
In most cases, someone with a higher tender price of almost 1,500% than the lowest bidder gets the job.
He cited the “rural power supply project for the connection of power grid No.1” (for 2011–2012) which was awarded at a price of RM41,736,809.77.
The lowest tender price, he added, was only RM7,775,000.00 – a difference of RM33,961,809.77.
He also cited the case of the “hybrid solar power system” for the Semporna islands.
He said the project was awarded at a tender price of RM95,282,322.00, which many deemed to be too high.
“With that amount of money, I can always get someone to build a power station,” Hiew said.
He added that a similar project was also awarded to another company for a whopping sum of RM81,475,281.42 to supply power to Pulau Banggi, off Kudat.
Hiew also drew attention to the infamous Pualau Gaya, which he said was in dire need of clean water supply.
“They need clean water more than electricity. In fact, they already have a power station there.
“But they’ve awarded a contract for the installation of a 4-km-long undersea power cable to generate power supply for Pulau Gaya at the cost of RM42 million.
“A random survey conducted with several qualified local contractors revealed that this can be done at just RM5 million,” he said, adding that the government would need another RM100 milion if a water supply project was to be implemented.

Silent Shafie

To substantiate his claims, Hiew also distributed copies of the detailed tender documents containing the list of projects and names of contractors to reporters.
He said that he received copies of the documents of the Sabah projects from Beruas MP (Perak) Ngeh Koo Han.
Hiew noted that Ngeh had questioned Shafie about the contracts, during the Budget 2012 debate session in the Parliament last week, but the minister refused to answer him.
Describing the irregularities as blatant corruption by those in power, Hiew urged the MACC to immediately conduct a thorough investigation into the matter.
“We call on the MACC to immediately conduct a thorough investigation as we cannot tolerate the manner the taxpayers’ money was being misused.
“We strongly believe there is a strong element of corrupt practice and abuse of power,” he said.
MACC will investigate
In a later development, the MACC said it was ready to probe into alleged irregularities with regards to rural development projects in Sabah.
MACC chief Abu Kassim Mohamed asserted it was MACC’s duty to investigate all corruption cases regardless of “who they were, without fear or favour”.
“It is our policy to investigate corruption when there is a complaint,” he told reporters after witnessing the signing of a Memorandum of Understanding between MACC and government-linked company (GLC) Sabah Electricity Sdn Bhd (SESB), at Wisma SESB, near here today.
Abu Kassim was commenting on Hiew’s expose of alleged irregularities in rural Sabah projects.
Questioned as to whether Sabah DAP had lodged an official complaint with MACC, Abu Kassim said the state MACC only had the media report to go on so far.
He said it was not an easy task to fight corruption, saying “last year alone, out of 944 cases reported throughout the country, 424 cases involved the offering or giving of bribes.”
“So far this year, we have already recorded 357 similar cases,” he added.

Miss Venezula, Ivian Lunasol Sarcos Colmenares Crowned Miss World 2011.

Monday, 7th November 2011

A woman who spent five years living in a nunnery and once dreamed of becoming a nun has been crowned Miss World 2011.

Miss Venezuela, Ivian Lunasol Sarcos Colmenares, beat contestants from 113 countries to the coveted title after impressing the judges in the categories of beach beauty, top model, talent, sports, and beauty with a purpose - where the contestants must demonstrate involvement in a charity project.
Ms Sarcos Colmenares, 21, one of 13 siblings, was orphaned at eight and spent five years studying at a nunnery. She dreamed of becoming a nun but her life took a different direction, as she gained a degree in human resources and worked for a broadcasting company before becoming a beauty queen.

She was the favourite for the Miss World title going into the final at Earls Court, London, yesterday evening but reacted with delight and disbelief when she was announced as the winner of the famous beauty pageant. Now she said she wants to use her title to help other people.

She said: 'Winning means everything to me and I hope to take advantage of being a winner in a productive manner. I’m unbelievably happy to have won and there are some incredible girls. I first and foremost want to help people in need. I would like to help people like me. I am an orphan. I would also like to help the elderly and troubled teenagers. As many people as I can.

'Unfortunately I lost both my parents at a very young age which led me to study for five years in a nunnery. I spent my five years in there and my dream was to become a nun.'

Over a billion viewers from around the world tuned into see her crowned the winner, with runner up prizes going to Miss Philippines and Miss Puerto Rico. Fans who were unable to follow the final on television were kept up-to-date on the internet via live streaming and Facebook updates and tweets.
Representing the UK, Miss England, Alize Mounter, and Miss Scotland, Jennifer Reogh, both made it into the top seven. But Miss Wales, Sara Manchipp, and Miss Northern Ireland, Finola Guinnane, did not make it to the semi-final.

This was the 60th year of the beauty pageant and to celebrate its diamond anniversary, it returned to the city where it all began. The first was held in London in 1951 during the Festival of Britain on the South Bank of the River Thames.

But throughout its 60 year history, the beauty competition has attracted critics as well as fans.
This year was no different and campaign groups, including London Feminist Network, Object and UK Feminista, voiced their opposition to the 'sexist contest'.

A statement on the London Feminist Network website rallied women to join a protest they held at Earls Court while the competition was taking place.

A statement on their website said: 'Let the organisers and all those profiting from the event know that we are all angry that such an event is once again being held here in London.

'Bring placards, banners and raise your voice against this appalling offence against women's equality. Let them know loud and clear that this event has no place in London in 2011.'

But Miss England director Angie Beasley disagreed with their sentiments and said the contest 'had changed with the times' because it was no longer just about looking good in swimwear.

She said: 'There is a talent, sports and Beauty With A Purpose round, which is the fundraising round, in the contest and the girls love taking part.

'Yes they have to look great to win but it's so much more than a beauty contest. These people should give it a chance instead of thinking it's just a bikini parade.

I'm all for women standing up for what they believe in which is why I run Miss England but I'm fed up of these protesters trying to bully us and push us around.

'We live in a free society where women have the right to choose. The contestants in Miss World are quite capable of making up their own minds if they want to enter or not and protesters shouldn't keep criticising the same decision. If you don't like it, don't watch it.'

The message that the competition is now about brains as well as beauty was shown by figures that revealed out of this year's contestants, more than half are studying for a degree, one in four are graduates and more than half speak at least three languages.

The contest was also revealed to have the support of Nelson Mandela. He sent a message which was read out during the final sending his greetings to all the contestants and congratulating them on their efforts for charities.

TV presenter Bruce Forsyth also took to the stage with his wife, Wilnelia Merced, who was crowned Miss World in 1975, while dance group Diversity and boyband Blue performed for the worldwide audience.
In her new role, Miss Venezuela will now spend the year visiting and supporting a range of global charity projects supported by Miss World's Beauty With A Purpose programme.
